Digital marketing is among the most visible yet heavily scrutinized areas for brands. The Advertising Board, operating under the Ministry of Commerce, imposed administrative fines totaling approximately 149 million TL across 927 files it examined in 2024; its 2021 guidelines for social media influencers have become the reference text for virtually the entire digital ecosystem today. Our office provides compliance and defense support to brands, digital agencies, marketplace advertising managers, and actors in the influencer ecosystem in this field.
Our service scope includes pre-review of campaign and advertising content under the Commercial Advertising and Unfair Commercial Practices Regulation and specialized Advertising Board precedent decisions; binding influencer collaborations to contracts in accordance with the Social Media Influencers Guidelines; and managing briefing processes. We prepare specialized opinions on high-scrutiny topics such as comparative advertising, price claims, absolute statements like "best / cheapest," refundable discount structures, filter and effect usage, and hidden advertising (native advertising). In investigations initiated by the Advertising Board, we prepare statements of defense and accompany our clients during oral proceedings and in administrative court proceedings against Board decisions.
In marketing communications, the Turkish Data Protection Law (KVKK) and the Commercial Communications Regulation must be read together. Proper maintenance of consent records for email, SMS, call, and push notification architectures; management of SMS Preference Service (İYS) registration and settings; legal foundation of profiling practices used for campaign segmentation; and establishment of data transfer frameworks with third-party CRM and email marketing tools are matters we regularly work on.
